AGC Golf is the ‘Promoter’ of the AGC Golf Tipping Competition, (the ‘Competition’). The Competition is a promotion run for golf fans (‘Participants’) to use their skill and knowledge to select 3 real golfers competing in any US PGA Tournament (plus the Australian Open and British Open) to form their Line-Up. Participants earn points based on where each golfer in their line up finishes in a Tournament (each Tournament will be a separate Tipping Competition). At the end of each Tournament, the winner will be the Participant who has accumulated the most points and the winner will win the entire prize pool (less a 10 percent allowance made for GST) for that Tournament. Entry costs is $10 per Tournament. Additionally, Participants may win monthly and yearly prizes based on their ongoing performance.
By providing contact details and submitting an entry into this Competition, Participants consent to receive promotional and other marketing messages from the Promoter and from the Tip2Win Pty Ltd, 'Platform Provider’ including messages sent electronically for an unlimited period of time. Individuals will be able to opt-out at any time by following the instructions included in each message sent by the Promoter or by the Platform Provider.
In addition to eligibility for individual Tipping Competition Prizes, all Participants will be eligible to win monthly and yearly prizes.
Other than participating in individual Tipping Competition, individuals may set-up their own Private Competitions with free and paid options.
Tipping Competitions are considered a game of skill for golf fans. Any prizes must be awarded on basis set out in these terms and conditions.
The Platform Provider, is responsible for administering this Competition, and will handle all customer enquires relating to AGC Golf Tipping Competitions on behalf of AGC Golf.
1.1. These Terms and Conditions govern entry and participation in the AGC Golf Tipping Competition, made up of a number of individual Tipping Competitions.
1.2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this Competition, these Terms and Conditions will prevail.
1.3. Entry into a Tipping Competition by any individual or group of individuals will be deemed acceptance of these Terms and Conditions. Any entry not complying with these Terms and Conditions will be deemed ineligible. The Promoter and Platform Provider reserve the right to disqualify any individual or group from the Tipping Competition if that individual or group fails to comply with these Terms and Conditions.
2. ENTRY CONDITIONS
2.1. Subject to clause 2.2, entry is open to all residents of NSW, VIC, SA, QLD, NT, TAS (WA and ACT are excluded from entry) who are 18 years of age or over, as of the date of entry (‘Participant’).
2.2. Employees and their immediate families of AGC Golf Pty Ltd, Tip2Win Pty Ltd and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.
2.3. Each Tipping Competition will be run as a Game of Skill; no element of chance will be involved in the determination of winners.
2.4. Entry fees collected will be awarded as prizes for each Tipping Competition.
2.5. Participants will not win physical cash but prize money that can be redeemed for gift vouchers for national retailers or other goods and services offered in the ‘Shop’ (‘Prize Money’).
2.6. Participants can redeem their Prize Money for gift vouchers or reward cards ‘Vouchers’ for any of the national retailers listed in the Shop or other method as offered in the ‘Shop’. Vouchers will be emailed to the Participants email address that was provided at the time .
2.7. The Shop is located at www.tip2win.com/index.php/shop and is where all Prize Money is to be redeemed.
The Promotion commences on 16th June 2018 at 00:01 AEST and concludes on 16th June 2019 at at 00:01 AEST. Participants in this Competition will be automatically entered into each subsequent competition, subject to the payment of any entry fees. Participants will be asked for credit card details on their initial registration, that credit card will be automatically charged for each Tournament they enter, including any Tournament conducted by an entity who is assigned these Terms and Conditions.
2.8. To enter the AGC Golf Tipping Competition, each participant will need to register online at www.tip2win.com. Registration is free. Entrants who have registered in any previous Tipping Competition will be automatically registered for each subsequent Tipping Competition.
2.9. The cost of entry into each Tipping Competition is $10.00 per Event/Competition. Failure to pay the entry fee will result in disqualification from the Tipping Competition.
2.10. Individuals may set-up their own separate paid or free private Tipping Competition and compete against their friends and family (‘ Private Tipping Competition’). If an individual creates a competition (the ‘Creator’), the entry fee charged will be at the discretion of the Creator. The maximum pool of entry fees for all participants in any private tipping competition will be capped at $5,000. All fees collected will be returned as Prize Money for each Private Tipping Competition redeemable in the Shop. The Creator of any Private Tipping Competition will be responsible for compliance with State, Territory and Commonwealth laws applicable to the Private Tipping Competition.
2.11. The Official 2018/2019 AGC Golf Tipping Competition Rules, available at www. tip2win.com/index.php/how-it-works, apply to this Competition, except to the extent of any inconsistency with these Terms and Conditions, in which case these Terms and Conditions will prevail.
3. HOW TO PLAY
3.1. Each PGA Tournament / Private Tipping Competition will have its own prize pool. The value of each prize pool will be the sum of all entry fees paid by the Participants.
3.2. To enter, Participants must use their golfing knowledge and skill to pick 3 Golfers per Tipping Competition. Participants may also select up to 3 Reserve Golfers per Tipping Competition, who will be used in the event that a Participant’s originally selected Golfer is scratched. A Participant’s selected Golfers will accumulate points for their Finishing Position in the Tournament as follows;
In the event of a Golfer being scratched prior to the start of the Tournament, that Golfer may be replaced by the Participant’s Reserve Golfer (in the order in which Reserve Golfers are originally selected by the Participant).
3.4. Golfers who tie for a Finishing Position will not reduce points. For example, if 2 golfers tie for 3rd place, each will receive the 18 points for the 3rd place finish.
3.5. The winner of the Tipping Competition will be the Participant with the most points at the end of each PGA Tournament.
3.6. The winner will receive the entire Prize Pool for that Tournament (less GST).
3.7. The Prize Pool of each Tipping Competition will consist of Prize Money to the value of 100% all the entry fees paid by the Participants.
3.8. In the event of a tie for 1st place between Participants, the Prize Pool will be shared equally with those who are tied.
3.9. All confirmed winnings will be allocated to the participants account as Prize Money (1 unit of Prize Money = $1.00 AUD).
3.10. Prize Money is valid for twenty-four (24) months from the date of issue.
3.11. If the Prize Money is not used in full within twenty-four (24) months of allocation, any unused Prize Money will be forfeited.
3.12. Prize Money can be redeemed via the Shop as gift vouchers for wide range of leading retailers as well as other goods and services offered in the Shop.
3.13. Redemptions for any non-AGC Golf gift cards may incur a 10% handling fee paid to the Platform Provider to cover the costs of sourcing and issuing the voucher. This handling fee will be deducted from a winner’s Prize Money at the time of redemption.
3.15. Participants must make their Golfer selections prior to the start of each Tipping Competition. For the avoidance of doubt, this will be the instance in which the first golfer in each tour event tees off, or as published on the AGC Golf Tipping Competition website. Note that not all tournaments start at the same time.
3.16. If one or more Golfers in a Participant’s Line-Up is ‘Scratched’ (i.e. was scheduled to play in the Tournament but does not start in the Tournament for any reason) prior to the commencement of any Tipping Competition, one or more golfers from the Participant’s Reserve Golfers will take their place in your Line-Up. If no Reserves are available to fill the place, it is the Participants responsibility to replace a scratched golfer prior to commencement of the Tournament. We encourage you to check your Line-Up prior to the Tournament commencing as it is the Participants responsibility to ensure their Line-Up is valid.
3.17. It is the responsibility of Participants to ensure that his/her tip has been entered correctly, Promoter and Platform Provider take no responsibility for tips that are entered into the system incorrectly.
3.18. Participants can edit their selections as many times as they like but all selections are set and final, and cannot be changed, from the start of each Tipping Competition
3.19. The results of each Tipping Competition will be published on www.tip2win.com within 24 hours of the PGA Tournament results being published on www.pgatour.com.
3.20. The winner/s will be notified by email and their winnings added to their account once the winners have been determined in accordance with the Terms and Conditions.
3.21. Participants will be auto-entered into each Tipping Competition when it opens for tipping. If a Participant does not wish to have auto-entry enabled
this can be switched off in the ‘My Account’ area of www.tip2win.com.
3.22. PGA Tournament results and player statistics are provided by Sports Radar LLC If there is difficulty obtaining official results or issues with scoring, the Tipping Competition may be settled the following day or whenever the final scores are available.
3.23. In the event that a tournament is cancelled, all Participants entries will be cancelled and refunded. If an event is postponed or delayed for a reasonable amount of time, as determined by the Platform Provider in its sole discretion, the Tipping Competition may remain live until which time the tournament is completed. After final Tournament results become available, the contests will be finalized and settled. The Platform Provider’s decisions in relation to any individual Tipping Competition will be final and no correspondence will be entered into.
3.24. No adjustment will be made to Prize Money allocation If results from any Tipping Competition are disputed, challenged or adjusted after prize/s have been allocated to winners.
3.25. The top 10 Participants who score the most points as displayed on the Yearly Leaderboard on 16th June 2019 AEST will share in $5,000 to spend at AGC Golf as follows: 1st = $2,500, 2nd = $1,000, 3rd = $500, 4th = $350, 5th = $250, 6th, 7th, 8th = $100 each and 9th, 10th = $50 each.
3.26. The ten (10) Participants who score the most points as displayed on the Monthly Leaderboard on the last day of each calendar month will each receive a $50 AGC gift voucher. All vouchers have a 12-month expiry.
4. GENERAL TERMS
4.1. Any cost associated with accessing the Tip2Win website is the participant’s responsibility and is dependent on the Internet Platform Provider used. A participant electing to access the Tip2Win website via wireless platforms for the purpose of registering for and/or entering a Tipping Competition may be subject to content service fees imposed by their telecommunications provider. No revenue sharing or commission arrangement exists between the Promoter and the telecommunications provider in relation to any such transactions.
4.2. The Promoter reserves the right, in its sole discretion, to verify participants’ identity. The Promoter may disqualify any entrant who tampers with or benefits from tampering with the entry process or the fair conduct or spirit of any Tipping Competition.
4.3. The Promoter reserves the right to reject registration from any individual or to cancel registration of any Participant if that individual or Participant is found by the Promoter to have acted or communicated in an offensive way, including but not limited to sending or publishing messages relating to the Competition which contain material which is racist, sexist, defamatory, or otherwise offensive.
4.4. Except for any liability that cannot be excluded by law, the Promoter and Platform Provider (including their respective officers, employees and agents) are not liable and do not accept responsibility for:
4.4.1. a participant's tips that are not received or which are received and subsequently corrupted or rejected by the web site server, whether or not after receipt by the promoter;
4.4.2. any lost, misdirected or corrupt emails to or from the Website;
4.4.3. the Website not being continuously available for use;
4.4.4. any loss or damage whatsoever (including but not limited to direct, indirect or consequential loss) or personal injury suffered or sustained in connection with a participant’s participation in the Competition or the taking of a prize or otherwise relating to the Competition, however caused, including failure of the web site or incorrect or corrupt data supplied by the promoter to a participant;
4.4.5. any theft, unauthorised access or third party interference;
4.4.6. any variation in the value of any prize; or
4.4.7. any tax liability incurred by a Participant or prize winner.
4.5. Information about participants is used by the Promoter and Platform Provider to assess and process registration in the Competition. If an individual does not provide the required information, the Promoter cannot process the registration. Information obtained from the Participant's participation in the Competition is used by the Promoter and its agencies associated with this competition for the determination of winners and distribution of prizes, if any, awarded to a Participant. Participants consent to having their name published in the results section of the web site and as otherwise set out in these Terms and Condition. The Promoter and Platform Provider will not be held responsible for any loss of reputation, status or otherwise in connection with a participant's tipping selections and consequential results. It is a condition of entry that Participants consent to these uses and disclosures of their information. Information about Participants may also be used by the Promoter, Platform Provider, its agents, contractors and related companies, for the purposes of carrying out marketing, including the sending of electronic messages, planning, product development and direct mail, telemarketing and promotional campaigns unless a participant otherwise withdraws their consent to the use of their information in this manner.
4.7. In the event there is a dispute concerning the conduct of the competition, the decision of the Promoter is final and no correspondence will be entered into.
4.8. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees').
4.9. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Platform Provider (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize The Promoter (including its' officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable guarantees. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
4.10. The Promoter reserves the right to update terms and conditions from time to time. Changes will be posted on the website.
4.11. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter’s legal rights to recover damages or other compensation are reserved.
